- What is the difference between CPT and OPT?
- CPT is work that is an integral part of your curriculum, authorised by your school's DSO. OPT is temporary work directly related to your major. OPT needs a DSO recommendation and then USCIS approval of Form I-765.
- Who approves CPT, and who approves OPT?
- Your designated school official (DSO) authorises CPT in SEVIS. For OPT, your DSO first recommends you in SEVIS. You then file Form I-765, and USCIS approves it and issues your EAD.
- Can I start working on OPT before USCIS approves it?
- No. USCIS says you may not begin OPT until it approves your Form I-765 and you receive your Employment Authorization Document (EAD).
- How long is OPT, and what is the STEM OPT extension?
- OPT gives up to 12 months of work authorisation. With a degree on the STEM Designated Degree Program List, you can apply for a 24-month STEM OPT extension.
- Does a STEM OPT employer need to use E-Verify?
- Yes. The STEM OPT extension must be with an employer enrolled in E-Verify. The employer also signs a Form I-983 training plan with you.
- What is the 90-day unemployment rule on OPT?
- On post-completion OPT you may have up to 90 days of unemployment. With the STEM OPT extension the limit is 150 days in total, including days used on post-completion OPT.
- Does full-time CPT affect my OPT?
- Yes. Students who complete one year or more of full-time CPT are not eligible for post-completion OPT. Ask your DSO before you take full-time CPT.
- How is the H-1B different from OPT?
- OPT is work authorisation tied to your F-1 student status. The H-1B is a separate work visa for a specialty occupation. Your employer must petition for it, and most H-1B petitions fall under an annual cap.
- How does the H-1B cap and registration work?
- The regular cap is 65,000 a year, plus 20,000 for holders of a US master's degree or higher. Employers register each person first. If needed, USCIS runs a selection weighted by wage level.
- Does the $100,000 H-1B payment apply to students already in the US?
- The Proclamation of 19 September 2025 does not apply to a change of status inside the US that USCIS grants. A court order of 8 June 2026 vacated the agency guidance for the payment. Read USCIS's H-1B page for its current status.
- Is there a new fee for OPT?
- Only a proposal. DHS proposed on 7 October 2026 a $70,000 fee per student for initial OPT and $30,000 for any later OPT, paid by schools. It is not in force.
- Which employers can sponsor an H-1B?
- The employer files the H-1B petition. Universities and certain nonprofit or government research organisations are exempt from the cap. insiderOne marks roles at employers that USCIS data shows have had H-1B approvals.
